UK judge issues damning press verdict

(AP) ? Britain's unruly newspapers should be regulated by an independent body dominated by non-journalists with the power to levy steep fines, a judge said Thursday in a report that pleased victims of tabloid intrusion but left editors worrying about creeping state control of the country's fiercely independent press.

Prime Minister David Cameron echoed concerns about government interference, expressing misgivings about a key recommendation of the report ? that the new regulator be enshrined in law. He called on the much criticized press to show it could control itself by implementing the judge's proposals quickly ? and without political involvement.

"I'm proud of the fact that we've managed to survive hundreds of years without state regulation," he said.

Lord Justice Brian Leveson issued his 2,000-page report at the end of a media ethics inquiry triggered by a scandal over tabloid phone hacking that expanded to engulf senior figures in politics, the police and Rupert Murdoch's media empire.

His key recommendation was to create a new print media regulator, which he said should be established in law to prevent more people being hurt by "outrageous" press behavior that had "wreaked havoc with the lives of innocent people whose rights and liberties have been disdained."

Cameron, under intense pressure from both sides of an issue that has divided his own Conservative Party, welcomed Leveson's proposal for a new regulator and said "the status quo is not an option."

But he said that asking legislators to enshrine it in law meant "crossing the Rubicon of writing elements of press regulation into the law of the land."

"I believe that we should be wary of any legislation that has the potential to infringe free speech and a free press," Cameron told lawmakers in the House of Commons. "In this House which has been a bulwark of democracy for centuries, we should think very, very carefully before crossing this line."

Leveson insisted that politicians and the government should play no role in regulating the press, which should be done by a new body with much stronger powers than the current Press Complaints Commission.

But the judge said it was "essential that there should be legislation to underpin the independent self-regulatory system."

He said the new body should be composed of members of the public including former journalists and academics ? but no more than one serving editor, and no politicians. It should have the power to rule on complaints, demand prominent corrections in newspapers and to levy fines of up to 1 million pounds ($1.6 million), though it would have no power to prevent material being published.

Membership would be voluntary, but newspapers would be encouraged to join in part to stave off expensive lawsuits ? the regulator would handle complaints that currently end up in court.

The proposal is similar to the system operating in Ireland, where a press council and ombudsman were set up in 2008 to make the print media more publicly accountable.

Critics of the tabloid press generally backed Leveson's findings.

"I welcome Lord Leveson's report and hope it will mark the start of a new era for our press in which it treats those in the news responsibly, with care and consideration," said Kate McCann, who was the subject of intense press interest after her 3-year-old daughter Madeleine disappeared during a holiday in Portugal in 2007.

Brian Cathcart of the group Hacked Off, which campaigns for victims of press intrusion, said Leveson had produced "a workable, proportionate and reasonable solution to the problems of press abuse."

He said Cameron's "failure to accept the full recommendations of the report is unfortunate and regrettable."

Cameron set up the Leveson inquiry after revelations of illegal eavesdropping by Rupert Murdoch's now-defunct News of the World tabloid sparked a criminal investigation and a wave of public revulsion.

The furor erupted in 2011 when it was revealed that the News of the World had eavesdropped on the mobile phone voicemails of slain schoolgirl Milly Dowler while police were searching for the 13-year-old.

Murdoch shut down the 168-year-old newspaper in July 2011. His U.K. newspaper company, News International, has paid millions in damages to dozens of hacking victims, and faces dozens more lawsuits from celebrities, politicians, athletes and crime victims whose voicemails were hacked in the paper's quest for scoops.

News International chief executive Tom Mockridge said the company was "keen to play our full part, with others in our industry, in creating a new body that commands the confidence of the public."

"We believe that this can be achieved without statutory regulation ? and welcome the prime minister's rejection of that proposal."

Leveson's 4 million pound ($6.4 million) inquiry heard evidence from more than 300 witnesses during months of hearings that provided a dramatic, sometimes comic and often poignant window on the workings of the media. Witnesses ranged from celebrities such as Harry Potter author J.K. Rowling and Hugh Grant ? who both complained of intrusive treatment ? to the parents of Dowler, who described how learning that their daughter's voicemail had been accessed had given them false hope that she was alive.

Leveson said that the ongoing criminal investigation constrained him from accusing other newspapers of illegal behavior, but concluded there was a subculture of unethical behavior "within some parts of some titles."

While many editors have denied knowing about phone hacking, Leveson said it "was far more than a covert, secret activity, known to nobody save one or two practitioners of the 'dark arts.'"

He said newspapers had been guilty of "recklessness in prioritizing sensational stories almost irrespective of the harm the stories may cause."

"In each case, the impact has been real and, in some cases, devastating," the judge said.

The hacking scandal has rocked Britain's press, political and police establishments, who were revealed to enjoy an often cozy relationship in which drinks, dinners and sometimes money were traded for influence and information.

Several senior police officers resigned over the failure aggressively to pursue an investigation of phone hacking at the News of the World in 2007. But Leveson said that "the inquiry has not unearthed extensive evidence of police corruption."

Leveson said over the past three decades, political parties "have had or developed too close a relationship with the press in a way which has not been in the public interest."

Those relationships reached right up to the prime minister's door. Former Murdoch editors and journalists charged with phone hacking, police bribery or other wrongdoing include Cameron's former spokesman, Andy Coulson, and ex-News of the World editor Rebekah Brooks, a friend of the prime minister.

Leveson acquitted senior politicians of wrongdoing, but recommended that political parties publish statements "setting out, for the public, an explanation of the approach they propose to take as a matter of party policy in conducting relationships with the press."

Cameron, who is tainted by his own ties to prominent figures in the scandal, said he accepted that proposal.

But politicians remained far apart on the broader issue of how, or whether, to regulate the press.

Cameron was holding talks Thursday with leaders of the other main parties in an attempt to thrash out agreement.

He faced a battle. Deputy Prime Minister Nick Clegg, leader of junior government partner the Liberal Democrats, differed from Cameron in backing the call for a new regulator established in law.

"We owe it to the victims of these scandals, who have already waited too long for us to do the right thing," he said.

Analysts say that it was possible for the coalition government's two parties to join forces and push through a version of the recommended legal changes.

But Steven Barnett, a communications professor at the University of Westminster, said that if that does not happen, he would not trust the British press to set up a truly independent regulator.

"One possibility is that in the end (the report) has no effect whatsoever," Barnett said. "The press can make some noises about regulating themselves. But in the end they will want to control themselves in ways that Leveson himself said was unacceptable."

Wave of bombings south of Baghdad kills 16

BAGHDAD (AP) ? Iraqi police and health officials say bombings in two cities south of Baghdad have killed at least 16 people and wounded over 65.

A police officer says back-to-back explosions on Thursday in a busy commercial area of the city of Hillah killed at least 10 people and wounded 45. He says the attacks started with a roadside bombing that was followed by a car bomb explosion when rescuers rushed to the scene.

Police and health officials say a car bomb blast at the gates of the southern city of Karbala killed six people and wounded 20 just hours earlier.

Both cities lie in Iraq's Shiite heartland in the country's south. All officials spoke on condition of anonymity because they are not authorized to talk to the media.

The blacklist compiled by the Federal Surveillance Service for Mass Media and Communications (Roskomnadzor) is secret, but authorities insist its purpose is to eliminate extreme forms of "offensive" content, such as child pornography, or advocacy of racism, terrorism, drug use and other anti-social behaviors.

The list is constantly changing and expanding (Russian bloggers have posted an alleged copy of it here) and citizens can suggest new entries by logging into an official Roskomnadzor website.

But in its first two weeks of application, the law has produced a few high-profile casualties that critics say point to the fundamental weaknesses of a system that allows authorities to summarily shut down content without any need for a court order or reference to any supervisory body.?

The definitions of "offensive content" are also murky, critics say, and could easily include political conversation that looks "extremist" to a policeman's eyes and other forms of commentary that might be simply misunderstood.

That criticism seems to have already been borne out. This week alone Roskomnadzor has closed down, among others,?a Wikipedia-like encyclopedia of satire, which contained an article about how to make hemp (often associated with marijuana) soup; an online library, which included a copy of "The Anarchist's Cookbook," a 1970's American-authored manual for radicals; and a popular torrent-tracking website, on which users had apparently exchanged a file called "The Encyclopedia of Suicide."

The agency allowed those websites to reopen after the "offensive content" was pruned. But experts say those examples were hugely popular websites whose closure attracted immediate public attention and a storm of complaints; restoring service may not prove so easy for smaller victims of the law.

"The first several days of operation of this law have confirmed our worst fears," says Oleg Kozyrev, a media analyst and popular blogger. ???

"Roskomnadzor can shut down a site within 24 hours, without appealing to a court. But in order to restore a resource, one has to complain and go to court. Even so, the rules for getting back online are not at all clear ... ?As a result, big resources like YouTube, or internet encyclopedias, or social networks are all under threat. They have millions of users, and some of them are inevitably going to post something deemed offensive. That could lead to the closure of the whole portal," which will be disruptive even if it's temporary, he says.

No loans, weak earnings still dog Twin Cities banks | Finance ...

Customers remain reluctant to borrow

Performance by Minnesota and Twin Cities banks continued to improve in the third quarter but only slightly, according to a quarterly survey by the Federal Reserve Bank of Minneapolis.

And the symptoms of that slow, meager economic recovery is taking a toll on banks, according to the Ron Feldman, a senior vice president at the Minneapolis Fed and author of the report.

The worst news in Feldman?s report was a continuing decline in lending in the Twin Cities. More than half of local banks have shown year-over-year declines in loans in each quarter dating back to early 2009, according to the report.

?Bankers will say that?s their biggest concern,? Feldman said. Loans provide banks with their highest profit margins, even when loan prices drop as they have in this competitive banking environment.

Although profitability crept a little higher in the quarter, the increase came from a reduction in failing loans ? which enabled banks to move some of their loss reserves to the bottom line ? not from gains in banks? core source of earnings.

?If this situation is going to last another six to nine months, we?ll say it?s a deviation from historical norms but not a big deal,? Feldman said. ?If this lasts three, four, five more years, then we?re looking at the lost decade, a long period of no growth.?

St. Paul-based Anchor Bank was one bank that managed to increase its lending during the quarter, but those gains came from taking customers away from other banks, said Anchor CEO Jeff Hawkins. ?That can?t go on forever,? he said.

Hawkins said he doesn?t see signs that his commercial or real estate customers will increase borrowing soon. ?They?re still building up their cash and they?re deleveraging (reducing their debt). Customers? utilization of their lines of credit is at historic lows. They?re waiting to see real increases in sales before they move, and they aren?t seeing that yet,? Hawkins said.

The reduction in problem loans has been under way for over two years, and banks have been cleaning up their balance sheets by charging off failed loans or by restructuring the loans so that the borrower can afford the new loan. In either case, the banks are able to reduce their amount of loss reserves ? provisions, in banking parlance ? and moving them to the bottom line.

A local exception to that loan quality improvement was in the commercial real estate and construction and development portfolios at some banks. Although Minnesota and Twin Cities banks continued to improve overall in those sectors, Feldman said ?outlier? banks continued to be weighed down by problem loans.

The portion of delinquent CRE loans at the median Twin Cities bank was approaching the region?s historical norm, which is near zero in the third quarter. But banks above the median ranged much higher in their failed loans, Feldman said. The Twin Cities bank that ranked at the 75th percentile had over 15 percent of its CRE loans failing.

Another reason that Twin Cities bank earnings aren?t climbing is the high number of foreclosed properties that they?re keeping on their books.

The Fed measured the percentage of foreclosed properties ? other real estate owned or OREO ? and found the median for Minnesota banks at 5 percent.

But Twin Cities banks above the median in OREO again ranged much higher; the bank at the 75th percentile was over 30 percent.

?That?s a really big deal to banks, because it?s costly to hold them ? to pay insurance, to maintain them, to try to market them,? Feldman said.

Runkeeper's got a new Holo look and get's friendly with some new features

The biggest of these is the new Friends tab, which ranks buddies gathered from your contacts and Facebook by the number of activities completed. You can find these buddies without leaving the app, and even give them a gentle poke if they seem to be slacking using Android's in-app messaging service.

The new holo look with tabs and action bar navigation is a welcome sight, there's a new activities page to help keep track of what you've done and what's coming up, and there's now a bit more flexibility when you sign up for a new training plan.

Flashpoints in 'fiscal cliff' negotiations

There are numerous hurdles, big and small, in front of President Barack Obama and lawmakers on Capitol Hill as they seek a budget and tax agreement to avoid economy-rattling tax increases and automatic spending cuts known as the "fiscal cliff." They include:

?Taxes. Obama insists on increasing taxes on upper-income earners and he's proposed raising the rates paid on family income over $250,000, with a boost in the top rate from 35 percent to 39.6 percent. GOP leaders vow to block any increase in tax rates but say they could support revenue increases as part of a tax reform plan that curbs tax breaks and uses the resulting revenue to both lower rates and defray the deficit. That approach, however, is opposed by many tea party GOP conservatives who have signed a pledge to oppose any tax increase.

?Entitlements. Big benefit programs like Medicare, Social Security and the Medicaid health program for the poor ? called entitlements because participation is based on eligibility criteria ? are major flash points. As a condition of voting for higher revenues, Republicans are demanding fundamental entitlement reforms such as increasing the Medicare eligibility age from 65 to 67, making wealthier seniors pay more for Medicare, and a less generous inflation adjustment for Social Security. Those ideas were discussed in negotiations in the summer of 2011 but Democrats seem to be signaling a harder line now.

?War spending. Obama and Capitol Hill Democrats want to claim $1 trillion or so in savings from the drawdown of troops in Iraq and Afghanistan as budget cuts. Many Republicans see the attempt as a gimmick since the savings are occurring anyway.

?Defense budget. Some Democrats want further cuts to the Pentagon on top of a 10-year $487 billion cut taken as part of last summer's budget and debt pact. Obama, however, has not proposed further cuts and GOP budget hawks swear they would hold the line against any further attempt to squeeze the military budget.

A photo of the Olympic gold medalist and President Barack Obama doing her now-famous "McKayla Maroney is not impressed" face went viral Saturday after the White House posted it on Twitter. The two took the picture Thursday when Maroney and U.S. Fierce Five teammates visited the White House.

"He was the one who brought it up," Maroney said. "We were about to leave and he said, 'I want to talk to you one second about the face.' He said, 'I pretty much do that face at least once a day.' "

Maroney, 16, was photographed making the half scowl with her nose scrunched up while she was on the medals podium after winning a silver on vault at the London Olympics.

The "face" soon became Maroney's trademark. But it's one thing for fans to ask her about it, quite another when the president does.

"I, like, freaked out," Maroney recalled. "He said, 'Let's do it together.' We took a picture and now it's everywhere."

The Los Angeles Times reports Donald Hallmark Sr. and Donald Hallmark Jr. also agreed to a nominal $497-million judgment against the now-defunct Hallmark Meat Packing Co., which will not be collected because the company is bankrupt.

The Hallmarks were two of nine defendants in a federal False Claims Act suit brought by the Humane Society of the United States.

The government recalled 143 million pounds of beef in 2008 after the Humane Society released video from the Chino plant showing cows too sick or injured to stand being dragged with chains and rammed with a forklift.

THE HAGUE, Netherlands (AP) ? The Yugoslav war crimes tribunal overturned the convictions of two Croat generals on Friday for crimes against humanity and war crimes committed against Serb civilians in a 1995 military blitz.

The decision, by a 3-2 majority in the five judge appeals chamber, is one of the most significant reversals in the court's 18-year history and overturns a verdict that dealt a blow to Croatia's self-image as a victim of atrocities, rather than a perpetrator, during the Balkan wars in the 1990s.

Neither Ante Gotovina nor Mladen Markac showed any emotion at the decision, but their supporters in the court's packed public gallery cheered and clapped as Presiding Judge Theodor Meron ordered both men freed immediately. On a lawn outside the tribunal, supporters sang, waved a Croat flag and sipped champagne.

The generals were returned to their jail cells to complete release paperwork before being flown back to Croatia, likely Friday afternoon.

"I think right now what he wants to do is go home to his wife, his little boy, his daughter," said Gotovina's American lawyer, Greg Kehoe.

Gotovina and Markac were sentenced to 24 and 18 years respectively in 2011 for crimes, including murder and deportation. Judges ruled both men were part of a criminal conspiracy led by former Croat President Franjo Tudjman to expel Serbs.

But the appeals judges said prosecutors failed to prove the existence of such as conspiracy, effectively clearing Croatia's entire wartime leadership of war crimes in the operation known as Operation Storm.

The operation came at the end of Croatia's battle to secede from the crumbling Yugoslavia and involved grabbing back land along its border with Bosnia that had earlier been occupied by rebel Serbs.

"Does this vindicate that particular operation as a proper and just attempt to bring back this land under Croatia? Of course," Kehoe said.

Croatian Prime Minister Zoran Milanovic called the ruling "an important moment for Croatia."

"We are talking about two innocent people. I say thank you to them for surviving so long for the sake of Croatia," he said.

Vesna Skare Ozbolt, former legal adviser of late President Tudjman, called the verdict "a victory of justice."

"It corrects all wrongs about our just war," she said. "This proves that there was no ethnic cleansing in Croatia and that it was all lies."

Tudjman died in 1999, while under investigation by the tribunal.

While supporters of the generals at home in Croatia cheered and set off fireworks, the acquittals enraged hardline opponents of the U.N. court in Serbia who accuse its judges of anti-Serb bias.

The headline in the Blic daily's online edition read: "Scandalous decision: Gotovina and Markac free as if there had been no operation Storm."

Some 600 Serbs were killed and more than 200,000 were driven from their homes during the operation.

Serbia's war crimes prosecutor Vladimir Vukcevic also branded the ruling "scandalous," saying it endangered the general principle that war crimes must be punished.

"This was one of the biggest war crimes in the former Yugoslavia, murder, expulsion and endangering of several hundred thousand people and no one was held responsible," Vukcevic told The Associated Press.

Gotovina's and Markac's convictions were one of the few at the tribunal to punish perpetrators of atrocities against Serb civilians. The majority of criminals convicted have been Serbs. The Bosnian Serb wartime leader and military chief, Radovan Karadzic and Gen. Ratko Mladic, are currently on trial for allegedly masterminding Serb atrocities.

Gotovina, 55, is especially popular among Croatian nationalists. The charismatic former soldier fought in the French Foreign Legion in the 1980s and spent four years on the run from justice before being captured in the Canary Islands in December 2005.

The verdicts against the two generals had triggered anti-Western sentiments among nationalist Croatians ahead of the country's planned European Union entry in July 2013.

After the convictions last year, thousands of Croatian war veterans massed in Zagreb and ripped EU flags and denounced Croatia's leaders who made EU membership their goal.

The original convictions were based on a finding that Croat forces deliberately used illegal artillery attacks on four towns to drive Serb civilians from their homes. But appeals judges overturned that key finding and said that therefore no criminal conspiracy could be proven.

Kehoe said the appeals judgment was not damaging for the tribunal, but in fact proved its impartiality.

"Is it a vindication for the rule of law and justice? Yes it is," he said.
