Londonderry unveils city of culture program

(AP) ? The Northern Ireland city of Londonderry has announced a program of arts events ranging from punk to painting to celebrate its role as the U.K.'s "city of culture" for 2013.

The program announced Thursday includes a new play by U.S. writer Sam Shepard staged by Field Day, the innovative local company founded in 1980 by playwright Brian Friel and actor Stephen Rea.

Other stage offerings are "Teenage Kicks," a punk musical inspired by local rock heroes The Undertones, and an open-air spectacle devised by Frank Cottrell Boyce, who scripted the opening ceremony of the London Olympics.

Nobel Literature prize-winning poet Seamus Heaney, who comes from Northern Ireland, will kick off a poetry festival in the city, which will also host an exhibition for art's Turner Prize, performances by the London Symphony Orchestra and a visit from the Royal Ballet.

The U.K. city of culture title is inspired by the continent-wide European capital of culture program. Londonderry is the first community to hold the title.

Organizers hope it will give an economic boost to Northern Ireland's second city, which is scarred by sectarian divisions that even extend to its name ? Protestants call it Londonderry, Roman Catholics Derry.

The city has been targeted by IRA dissidents in a series of shooting and bombing attacks, including an incident in which a small bomb in a backpack was left outside the City of Culture offices.

Despite this, Northern Ireland's peace process has helped transform the city's fortunes. It was recently named one of the best cities in the world to visit next year by the Lonely Planet travel guides.

Kids' mountain bike program likely the first of many in Old Town ...

Ten children in Old Town learned the joys of mountain biking during a monthlong program for grades 4-8 that ran mid-September through mid-October.

The program was made possible by a first-of-its-kind collaboration of three Maine-based organizations: Old Town Recreation, Maine Winter Sports Center and the Bicycle Coalition of Maine.

?They were very excited to just go out and experience the outdoors,? said Kevin McPhee, director of Old Town Recreation, which hosted the program. ?We have a river trail here in the Old Town-Orono area that goes along the Stillwater River. It?s just a beautiful bike trial, and they were able to experience that on a couple of occasions.?

Biking in the mud was their favorite part.

?They usually came back and had mud up their backs and huge smiles,? McPhee said. ?Their parents would come to pick them up and just shake their heads and smile.?

Healthy Hometowns, the community development program of the Maine Winter Sports Center, provided mountain bikes and helmets for participants, as well as training and curriculum for leaders.

?The focus of this program was on experiencing the lifelong, active outdoor pursuit of mountain biking,? said Central Maine Healthy Hometowns coach Lauren Jacobs. ?Kids had a blast exploring the trails, getting muddy and becoming skilled bikers.?

In April, L.L.Bean announced a $1 million donation to Healthy Hometowns to expand the program into a year-round, statewide effort. This donation coincides with L.L.Bean?s mission to get more children outdoors during their 100th anniversary year and beyond.

?In the past, Healthy Hometowns has been primarily cross-country ski-oriented and mostly in the County, up in Aroostook,? Jacobs said. ?With the funding in April, we can go statewide and year-round. This is the first time we?ve had equipment to use in other regions.?

The funding is providing staff, training and resources for Healthy Hometowns expand its focus to outdoor activities such as paddling, hiking, mountain biking, orienteering and camping.

So far, the donation enabled Healthy Hometowns to purchase 20 mountain bikes, three boat trailers of kayaks, and expand their ski collection to approximately 1,500 sets of skis. The program ?coaches? have started spreading out across the state, and the equipment supply will continue to grow over the next three years, Jacobs said.

The 10 children who participated in the Old Town mountain bike program gained skills and confidence through riding on local trails and fields and engaging in a variety of games and activities used to teach bike handling, shifting, braking, safety and navigating obstacles.

The Bicycle Coalition of Maine, a statewide cycling advocacy group, supported the initiative with a safety program for participants and program leadership by a coalition employee.

?Participants markedly improved their biking skills while getting great exercise and getting the opportunity to experience the great Maine outdoors as it was meant to be enjoyed,? McPhee said.

During the summer, Healthy Hometowns and Old Town Recreation worked together to provide kayaking and biking opportunities to summer camp participants. And this winter, the two organizations will work together for the third year to offer a youth cross-country ski program in conjunction with the Penobscot Valley Ski Club.

?This will be an ongoing effort,? McPhee said. ?We look forward to doing this spring, summer, fall and winter. We look forward to partnering with them each season to provide a different activity.?

Healthy Hometowns trailers filled with cross-country skis and snowshoes will travel throughout the state all winter to give children the chance to experience winter sports. Several schools in the Bangor area have booked the equipment, including schools in Winterport, Hampden, Bangor and Dover-Foxcroft.

?We are really focused on winter right now, planning winter sports, getting out calendars filled up and getting ready to do our ski weeks,? Jacobs said. ?But it won?t be long before we start thinking about spring and getting programming lined up. We already have a couple of requests ? Milo has already scheduled the mountain bikes for their outing club members for some time in May.?

Best Buy warns on profit; U.S. unit head to leave

(Reuters) - Retailer Best Buy Co Inc on Wednesday warned earnings and same-store sales would fall for its fiscal third quarter, and said the head of its U.S. business will leave as it starts to restructure under a new chief executive.

Best Buy shares fell 6.8 percent in after-hours trading. The news came less than a month before the unofficial start of the biggest selling season of the year for the No. 1 U.S. electronics chain.

U.S. business president Mike Vitelli will exit at the end of the current fiscal year in early February with a lump-sum payment of $1.45 million. The executive vice president of U.S. operations will also depart.

The move is the first big structural change under new CEO Hubert Joly, who was brought in as the company grapples with the rising trend of shoppers who treat its stores like showrooms for cheaper online retailers.

In August, the world's largest consumer electronics chain suspended profit forecasts and share buybacks for the rest of the year to give its newly named chief executive time to construct his own turnaround plan.

The company is also waiting for its former CEO and largest shareholder, Richard Schulze, to decide whether he can put together a buyout bid.

Yet one analyst said the most troubling news of all was a decline in the company's gross margins, which suggests how aggressive it has become with promotions to lure customers.

"If they try to compete on price they are doomed. Their cost structure doesn't allow that," said Wedbush Securities analyst Michael Pachter. "They have to figure out how to charge a higher price and make shopping in their stores a rewarding experience."

EARNINGS WEAKNESS

Best Buy said it now expects earnings for the fiscal third quarter ending November 3 to fall "significantly below" those of a year earlier, excluding one-time items, due to falling margins and declines at sales at established stores.

Analysts polled by Thomson Reuters I/B/E/S on average had expected earnings per share of 36 cents in the quarter. In the fiscal third quarter a year earlier it earned 47 cents per share on an adjusted basis.

"I think people were looking for more out of the third-quarter results given that we had some big product launches," said Morningstar analyst R.J. Hottovy. "Even though it was toward the end of the quarter, you had the iPhone 5 out there."

The retailer also warned same-store sales would decline in the low-to-mid single digits for the period. Best Buy has posted same-store sales declines in eight of the last nine quarters.

Best Buy shares fell to $15.77 in after-hours trading from a $16.92 close on the New York Stock Exchange. The company also said Wednesday that it would hold an investor day on November 1 to discuss Joly's plans for the future.

Giants on to World Series with 9-0 win over Cards

SAN FRANCISCO (AP) ? In a postseason full of twists and turns, the San Francisco Giants are headed back to the World Series after a remarkable comeback against the defending champs.

Hunter Pence got the Giants going with a weird double, Matt Cain pitched his second clincher of October and San Francisco closed out Game 7 of the NL championship series in a driving rainstorm, routing the St. Louis Cardinals 9-0 on Monday night.

San Francisco won its record-tying sixth elimination game of the postseason, completing a lopsided rally from a 3-1 deficit.

"We're going to the World Series, this is unbelievable," series MVP Marco Scutaro said.

The Giants, who won it all in 2010, will host reigning AL MVP and Cy Young winner Justin Verlander, Triple Crown slugger Miguel Cabrera and the Detroit Tigers in Game 1 on Wednesday night.

Verlander is set to pitch Wednesday's opener at AT&T Park. Gianst manager Bruce Bochy insisted before Monday's game he had not planned any further in advance.

Scutaro produced his sixth multihit game of the series and matched an LCS record with 14 hits and Pablo Sandoval drove in a run for his fifth straight game.

"These guys never quit," Bochy said. "They just kept believing and they got it done."

After falling behind 3-1 in the series at Busch Stadium, the Giants outscored the wild-card Cardinals 20-1 over the final three games behind stellar starting pitching from Barry Zito, Ryan Vogelsong and Cain.

They also benefited from some strange bounces.

On Pence's double that highlighted a five-run third, his bat broke at the label on impact, then the broken barrel hit the ball twice more. That put a rolling, slicing spin on the ball and caused it to change directions ? leaving shortstop Pete Kozma little chance to make the play. Kozma broke to his right, figuring that's where the ball would go, but it instead curved to left-center.

Injured closer Brian Wilson, with that out-of-control bushy black beard, danced in the dugout and fans in the sellout crowd of 43,056 kept twirling their orange rally towels even through rain in the late innings ? a downright downpour when Sergio Romo retired Matt Holliday on a popup to Scutaro to end it.

"This rain never felt so good," Scutaro said.

Romo embraced catcher Buster Posey as fireworks went off over McCovey Cove beyond right field.

The NL West champion Giants won their first postseason clincher at home since the 2002 NLCS, also against the Cardinals.

These 2012 Giants have a couple of pretty talented castoffs of their own not so different from that winning combination of 2010 "castoffs and misfits" as Bochy referred to his bunch ? with Scutaro right there at the top of the list this time around.

Acquired July 27 from the division rival Colorado Rockies, Scutaro hit .500 (14 for 28) with four RBIs in the NLCS. The 36-year-old journeyman infielder, playing in his second postseason and first since 2006 with Oakland, became the first player in major league history with six multihit games in an LCS.

Now, he's headed to his first World Series.

The Giants have All-Star game MVP Melky Cabrera to thank for helping his teammates secure home-field advantage in the postseason ? while Cain was the winning pitcher the National League's 8-0 victory in July. Cabrera was suspended 50 games Aug. 15 for a positive testosterone test, then wasn't added to the roster by the Giants after his suspension ended.

After rain fell on the Cardinals during batting practice, the skies turned blue and the weather cooperated. Anxious players on both sides hung over the dugout rails as the game began.

Cain joined St. Louis' Chris Carpenter as the only pitchers with victories in two winner-take-all games in the same postseason. Carpenter, who lost Games 2 and 6 in this series, did it last year.

Cain also pitched the Giants' Game 5 division series clincher at Cincinnati, when San Francisco became the first team in major league history to come back from an 0-2 deficit in a five-game series by winning three consecutive road games.

"I think to do it, the guys actually have to believe it can happen," Posey said.

He delivered on an even bigger stage Monday as San Francisco saved its season once again. The Giants won their 20th NL pennant and reached their 19th World Series.

Cain walked off the mound to a standing ovation when Jeremy Affeldt entered with two outs in the sixth. Affeldt then got Daniel Descalso to pop out with two runners on.

Yadier Molina had four hits but got little help from the rest of the Cardinals, who went 1 for 21 with runners in scoring position over their final three games.

"It's about the team that's hot, and we went on a cold streak," Cardinals manager Mike Matheny said. "We got to this point by being that team that was hot and taking advantage of opportunities. But we just couldn't make it happen these last two games."

Cain added an RBI single to his cause and got some sparkling defense behind him.

The play of the game went to shortstop Brandon Crawford, who made a leaping catch of Kyle Lohse's liner to end the second inning with runners on second and third that would have been a run-scoring hit.

In the third, Scutaro, the second baseman, made a tough stop on a short hop by Carlos Beltran, and left fielder Gregor Blanco ran down a hard-hit ball by Allen Craig in left-center to end the inning.

Cain's second-inning single made San Francisco the first team in major league postseason history to have a starting pitcher drive in a run in three straight games.

Brandon Belt hit a solo homer in the eighth for his first clout of the postseason.

It took production from everybody, even the pitchers, for these scrappy Giants to rally back from the brink one more time.

Cain certainly did his part to keep the staff rolling.

The 16-game winner, who didn't surrender an earned run during his team's title run two years ago, reached 46 pitches through two innings but settled in nicely the rest of the way to avenge a loss to Lohse in Game 3.

Cain even got to repay Holliday for his hard slide into Scutaro at second base in Game 2 here a week earlier. Cain plunked Holliday in the upper left arm leading off the sixth, drawing cheers from the crowd.

The right-hander escaped trouble in the second with runners on second and third when Crawford made his catch.

Holliday returned to the lineup after missing Game 6 a night earlier with tightness in his lower back. He received loud boos when he stepped in to hit in the first from a fan base still angry about his slide that injured Scutaro's hip.

Beltran is still left 0-fer the World Series, winless in three Game 7s during his 15-year career. And to think just last fall he was on the other side with the Giants as they missed the playoffs a year after winning the club's first World Series since moving West in 1958.

The Cardinals went an NL-best 12-4 from Sept. 16 to the end of the season to earn the NL's second wild card on the second-to-last day of the season, then won 6-3 in a winner-take-all playoff at Atlanta to reach the division series. The Cardinals then rallied from a 6-0 deficit with a four-run ninth inning to stun the Washington Nationals 9-7 in Game 5.

Scutaro joined Hideki Matsui (2004 Yankees), Albert Pujols (2004 Cardinals) and Kevin Youkilis (2007 Red Sox) with 14 hits in a league championship series.

Sandoval's run-scoring groundout in the first that put his team ahead gave him at least one RBI in five straight postseason games, matching home run king Barry Bonds' franchise record set in 2002.

NOTES: The Giants snapped an 0-5 skid in deciding Game 7s. ... The Tigers and Giants will meet for the first time in the postseason. ... Beltran stole his third base of the postseason in the first, making him 11 for 11 in his postseason career ? most in a postseason without being caught. ... This was the first NLCS Game 7 since 2006, when the Cardinals beat the Mets and Beltran struck out looking against Adam Wainwright with the bases loaded to end it. ... The Giants are 11-17 in franchise history facing elimination.

Mood Mate: Great Mental Health App, Could We Get One Like It ...

Sometimes the time for an app has just come.

Launched on World Mental Health Day?on October 10, a new mental health app already has?more than 1,500 downloads and a #3 ranking among free Health & Fitness apps?and, lest we forget, a mention on Twitter by none other than Alistair Campbell, Tony Blair?s former spokesman who now campaigns on mental health.

It?s got the properly British name of Mood Mate, as the application comes out of the University of Reading, where researchers are studying whether an iOS app could, as they write, ?help people with low mood and anxiety to find and seek local treatment.?

And after all my beefs about mental health apps not being backed up by research (see ?We Know There?s an App For That? But Often Research Lags Behind Mobile Mental Health App?Claims?),?this app continues the research even as it is being utilized.

Alex Gyani, a researcher at the University of Reading Department of Psychology, devised a way for people to use an app?and for research data to be gleaned from it at the same time.

Mr Gyani said: ?Having a randomised [forgive the spelling; he's a Brit] controlled trial built into an app that is available on the iTunes store is a fantastic way to conduct research ? and the more participants we can recruit, the more we will learn.?That?s why an app is such a great way to conduct a trial like this one.?

He continues, ?We hope it will enable us to find new ways to help people suffering from mental health problems in the UK get the psychological treatments that have been shown to work.?

So users of the app become subjects when they download it. People are only eligible to be part of the study?although given the number of downloads, seems like people who are not officially part of the study find the app useful, as well?if they?re suffering from anxiety or low mood.

The study is structured so that two-thirds of those who download the app are asked to monitor their moods for 30 days and are given information about where to find local services where they can receive mental health help, without going through a GP, the equivalent of a primary care physician.

In a really cool move, the treatments recommended are part of the National Health Service?s ?Improving Access to Psychological Therapies initiative, or IAPT, on which the government has spent ?400 million since 2007,?and are therefore free. [Can you see this happening in the States? Free medical care for mental health? Seems like that could be a big part of the holdup in getting a similar app here Stateside.]

The remaining third just get the information about where to find services without monitoring mood.

The point, you might ask? Researchers are trying to determine whether monitoring mood encourages people to seek out treatment.

You can find more about the app from its Tweets (handle @MindAboveMood), from its website, and from reading the reviews on iTunes?where you can purchase it, as well?for nothing down?if you happen to be British.

Mood Mate would certainly have to be tweaked to fit into an American approach to medicine (and lose the word ?mate,? as well, I?m sure)?but it doesn?t seem all that hard, if someone takes an interest. Well, maybe if you cut out that offering free services, too.

What an utterly unAmerican idea.

Microsoft's Windows gets major makeover

Over the years, Keith McCarthy has become used to a certain way of doing things on his personal computers, which, like most others on the planet, have long run on Microsoft?s Windows software.

But last week, when he got his hands on a laptop running the newest version of Windows for the first time, McCarthy was flummoxed.

The Start button for getting to programs and the drop-down menus that list their functions is gone.

It took McCarthy several minutes just to figure out how to compose an email message in Windows 8, which has a stripped-down look and on-screen buttons that at times resemble the runic assembly instructions for Ikea furniture.

?It made me feel like the biggest amateur computer user ever,? said McCarthy, 59, a copywriter in New York.

Windows, which has more than 1 billion users around the world, is getting a radical makeover, a rare move for a product with such vast reach. The new design is likely to cause some head-scratching for those who buy the latest machines when Windows 8 goes on sale Friday.

To Microsoft and early fans of Windows 8, the software is a fresh, bold reinvention of the operating system for an era of touch-screen devices like the iPad, which are reshaping computing. Microsoft needs the software to succeed so it can restore some of its fading relevance after years of watching the likes of Apple and Google outflank it in the mobile market.

To its detractors, though, Windows 8 is a renovation gone wrong, one that will needlessly force people to relearn how they use a device every bit as common as a microwave oven.

?I don?t think any user was asking for that,? said John Ludwig, a former Microsoft executive who worked on Windows and is now a venture capitalist in the Seattle area. ?They just want the current user interface, but better.?

Ludwig said Microsoft?s strategy was risky, but it had to do something to improve its chances in the mobile business: ?Doing nothing was a strategy that was sure to fail.?

Little about the new Windows will look familiar to those who have used older versions. The Start screen, a kind of main menu, is dominated by a colorful grid of rectangles and squares that users can tap with a finger or click with a mouse to start applications. Many of these live tiles constantly flicker with new information piped in from the Internet, like news headlines, email subject lines and Facebook photos.

What is harder to find are many of the conventions that have been a part of PCs since most people began using them, like the strip of icons at the bottom of the screen for jumping between applications. The mail and calendar programs are starkly minimalist. It is as if an automaker hid the speedometer, turn signals and gear shift in its cars, and told drivers to tap their dashboards to reveal those functions. There is a more conventional ?desktop? mode for running Microsoft Office and older programs, though there is no way to permanently switch to it.

Microsoft knew in summer 2009 that it wanted to shake up Windows. It held focus groups and showed people prototypes of the tile interface and its live updates.

?We would get this delightful reaction of people who would say, ?This is so great, and it has Office too,? ? said Jensen Harris, Microsoft?s director of program management for the Windows user experience.

As work on Windows 8 proceeded, the company let the wider public test it. Sixteen million people have been using early versions, providing feedback either automatically or in discussion forums.

The boldness of the changes has delighted some early users, who say they believe that for the first time, the company is taking greater creative risks than its more celebrated rival, Apple.

To help it gain traction in the mobile market, Microsoft made Windows 8 a one-size-fits-all operating system for touch-screen tablets, conventional computers with keyboards and mice, and newer devices that combine elements of both. (Confusingly, Microsoft is also introducing a separate but similar operating system, Windows RT, that cannot run older programs.) The company?s latest software for phones has the same tile-based aesthetic.

Apple took the opposite approach with the Mac and mobile devices like the iPad, which have distinct interfaces, albeit with some shared underlying technologies. Timothy D. Cook, Apple?s chief executive, has been dismissive of Microsoft?s strategy. ?You can converge a toaster and refrigerator, but these things are probably not going to be pleasing to the user,? he said this year.

Jakob Nielsen, a user interface expert at the Nielsen Norman Group, conducted tests with four people who used a traditional computer running Windows 8 and found that they had ?a lot of struggles? with the new design. Nielsen said the users appeared to become especially confused when shifting back and forth between the modern Windows 8 mode and the desktop mode.

Nielsen said that Windows 8 was more suitable for tablet computers with their smaller touch-sensing displays, but that it was not helpful for workers who need to have lots of applications visible at once, sometimes on multiple screens.

?I just think when it comes to the traditional customer base, the office computer user, they?re essentially being thrown under the bus,? Nielsen said. ?It?s not very suitable for any situation where you have to manage complex data.?

Microsoft disputes this idea. Harris said most test users did not have trouble juggling the two modes ? and regardless, workers were more likely to operate in desktop mode if they wanted to see many applications simultaneously. He said that even people who did not use the software?s new interface much would enjoy the way it sped up their computers.

Microsoft is convinced that most people will quickly become accustomed to Windows 8. But to help ease the transition, the software offers tutorials when it is first started up. And Microsoft is spending more than $500 million on a marketing campaign that is partly intended to familiarize people with the new design.

Harris said the company needed to modernize Windows for the way people use computers today: ?We?re not surprised people have a strong reaction to it.?

Are UK Stock Markets Still Viable for International Investment?

Seeing as the UK still ranks as the sixth largest national economy in the world, and is home to one of the world?s most renowned stock exchanges, UK stock markets are certainly still viable for international investments.

Some of the benefits investors stand to gain from investing in UK-listed financial securities include the following:

  • Ready access to blue chip stocks: The UK houses many of the largest blue chip companies in the world, ranging from GlaxoSmithKline (LSE:GSK) to British American Tobacco (LSE:BATS); this makes investing in the region less risky than investing in many other financial markets around the world.
  • Access to advanced financial trading floors and systems: Second to only the New York Exchange, the London Stock Exchange is widely believed to be one of the most technologically and systemically advanced securities trading platforms in the world.

Nevertheless, one major risk that investing in UK stock markets generally involves rises from the fact that the UK economy is predominantly service-based. As a matter of fact, as is common with many developed economies the world over, over 70% of the economy consists of service-oriented industries. Notwithstanding that this phenomenon often assures greater stability, it still poses a very risky situation for domestic and international investors alike as even the slightest changes in consumer credit levels and commodity prices can very quickly result in problems and losses for investors. Moreover, the inherent risks are further heightened in light of the fact that the UK economy is highly dependent on consumers.

For US investors seeking to invest in UK-listed financial securities, there are a number of alternative avenues to take. Stocks can be purchased directly on the London Stock Exchange. Investors can also opt to make use of US brokerage accounts that offer international trading capabilities. In some situations however, prospective investors may be obligated to open foreign brokerage accounts.

In specific terms, some of the investment products that have proven to be quite appealing to international investors are easy-to-use exchange-traded funds (ETFs) and American Depository Receipts (ADRs). ETFs are investment products that provide investors with diversified exposure in single securities that can be traded like standard stocks; whereas, ADRs are US-listed securities that mimic the movement of foreign stocks. Some viable ADRs for investment in the UK are stock in GlaxoSmithKline, Barclays (LSE:BCS), BP Plc. (LSE:BP), BHP Billiton Plc. (LSE:BBL), and Rio Tinto (LSE:RIO). Asides ADRs and ETFs, there are also some more complex direct investment alternatives available on the London Stock Exchange.

With regard to their foreign investments, it is of paramount importance that investors endeavor to be aware of applicable tax or legal implications before embarking on any particular investment path.

Busy-Dad-E: Fatherhood Uncensored: After-Church Snack

Hello there! ?I hope you had a nice weekend.

I think it's safe to say that following the service, many churches have coffee, donuts/cookies, and fellowship afterwards. ?Ours is no different.

After running around in the grass outside the church with some good friends (okay, they didn't run around with Mom-E and Dad-E's friends, but rather their children) for a solid 20 minutes, the boys were ready to munch.

However, this week the boys opted for a very different kind of snack.

Within about a minute of being strapped into his carseat (I guess technically we should call it his vanseat), Bab-E Brother had tossed off his shoes and his socks, and was happily "munching" on his TOES!

Yes, toes. ?Yuck. ?And for me, it makes no difference that he'd had a bath about 30 minutes before we left for church. ?Toes = Yuck. ?Period.

And not just a little peck or sniff. ?He was going to town.

I guess this shouldn't surprise me. ?After all, this is the child who likes to SMELL my sweaty shirt when I get home from a run.

"Dad-E, can I smell you?" he says with bright eyes and eager anticipation.

"Okay, if you really want to," I reply, with trepidation.

And we're not talking about smell like when you inadvertently discover that someone else in the room has effluviated, I mean like "getting your nose right into the pan of hot brownies from the oven and sniff as deeply as you can", kind of sniff.

So, if he likes that, I guess it makes sense that his toes are (somehow) desirable, too.

And I also learned there's a reason why people still ask things like "If your friend did [insert danger], would you do it, too?"

Because following the response to Bab-E Brother's "snack", the next thing you know we have a van-load full of 3 boys happily trying to stick their toes in their mouth. ?Nice.

Really, I promise that we do feed our children actual food. ?More than once a day, even.

On the other hand, perhaps Mom-E and I have stumbled on a solution to chronic complaints of "I'm hungry", most often uttered 1) 2 minutes after we've eaten, or 2) when we're as physically far away from food or drink as we possibly could be.

"Hey, the last time you boys were hungry, you opted to stick your toes in your mouth. ?Bon appetit!"

Have a good week,
Keep your toes inside your shoes at all times,
Busy-Dad-E

SPICY IP: Spicy IP Weekly Review (October Week 3)

This week (October 15-21) has seen its due number of happenings within the country and beyond insofar as the IP scenario is concerned, with 8 posts having been put up in the blog, covering a varied range of events.

Guest Post on Xerox Victory

?

It started with a guest post by Adarsh Ramanujam, an IP lawyer, analyzing the impact in the Indian trademark law scenario of the judgment Ilango v. Rank Xerox Ltd. & Ors., wherein Xerox Corporation has won a significant victory before the IPAB in preventing ?Xerox? being declared a generic mark and hence invalidating the trademark protection currently accorded to it. The factors that the IPAB had considered to reach its decision include ?public acceptance of the trademark rights? of the Xerox Corporation, ?long continuous existence on the register?, which was uncontested by competitors and the presence of alternative words like ?photocopy? to describe the goods/services involved. Curiously enough, throughout the judgment, no reference has been made to the existing legal provisions, such as S. 9(1) of the Trade Marks Act, 1999, which one would have thought had a close bearing in the determination of whether the trademark should remain on the register or otherwise.

Guest Post on TRIPS-Compliance of Bayer-Natco Decision

This was followed by another informative guest post by Dr. Enrico Bonadio, an IP attorney and a lecturer of IP and EU law at The City Law School University, London, who sought to determine the TRIPS-compliance of the recent Bayer-Natco decision involving India?s first compulsory license of a patent. This post went on to analyze the Controller?s decision to interpret the ?local working? (or lack thereof) requirement to be satisfied for compulsory licensing, as to mean nothing short of local manufacturing and not merely local importation, with reference to S. 83(b) of the Patents Act. However, Dr. Bonadio opined that a combined reading of A. 31 and A. 27(1) of the TRIPS would reveal that where national legislations impose a local working requirement, patentees should have the possibility of satisfying such requirement by showing to have imported locally the patented product. Nor could Paragraph 5(b) of the Doha Declaration be invoked to justify the need of a local production requirement and hence a question remains regarding the degree to which the Controller?s decision is compliant with TRIPS requirements.

Internet Fraud by Fake Open Access Journals

The rising trend of the crime of internet frauds by way of soliciting papers for Open Access Journals was then brought into light by Mathews, who went on to lay down the provisions of the Information Technology Act, 2000 and the IPC applicable to such a crime. The practice essentially involves people sending mails on behalf of an Open Access Journal to researchers and scientists soliciting manuscripts, enticing the latter by keeping the processing fee low and the processing time quick, while in reality, such journals do not exist.

Sugen?s Efforts to save Sunitinib Patent

Prashant then carried a post reflecting the rather grim state of affairs in India?s still-ongoing struggle to come to terms with the basic of post-grant patent oppositions, as reflected in Sugen Inc.?s desperate attempts to save its patent for Sunitinib that had recently been revoked by the Patent Office. Not only has Sugen filed a writ petition before the Delhi High Court asking for the revocation to be set aside on the rather flimsy ground that a copy of the report of the Board of Oppositions has not been made available to Sugen, what?s even more astonishing is that, based on this petition, the court has then proceeded to restrain Cipla from releasing its generic drug in the market, which essentially amounts to an interim injunction against a private party, through a writ petition. The matter is due to be heard by a Single Judge on December 6, 2012.

Use of Bata in Bollywood Song not Defematory: holds Delhi High Court

This was followed by a post by Kruttika, referring to the manner in which, the Delhi High Court?s decision of disallowing the use of the word Bata in a disparaging manner in a song of Prakash Jha?s new movie Chakravyuh, was overruled by the Division Bench of the same court. Bata had contended that the use of its trade name in the context of this particular song laced with inferences about inflation, corruption, greed and exploitation by big corporate houses would lead the listener to view Bata in a negative light. However, the DB agreed with the opponent?s contentions that the use of the trade name in the song was rhetoric hyperbole and merely referred to the socialist and political struggle between the haves and the have-nots that the film is based on. Therefore, it was not a matter of defamation.

Copyright Office?s Errors with Register of Owners

Next came another post by Prashant, highlighting the manner in which the Copyright Office had erred previously in not insisting that the Indian Performing Rights Society, once having been registered as a copyright society, submit a Register of Owners as required under the prevalent rules. The register, detailing the list of persons who owned the copyright in works being administered by IPRS, was the only way in which the identity of the people, who could control IPRS, could be legally ascertained. With the Copyright Rules, 2012 being just around the corner and the Copyright Office gearing up to register new copyright societies, Prashant?s observation was of particular significance, lest the old errors be repeated once again.

Controller?s Decisions in September, 2012

Rajiv then posted his latest data compilation of the Controller?s decisions for the Month of September, 2012. Out of the 94 decisions, 46 patents were granted, 33 refused (including abandoned and withdrawn) and no file uploaded for the remainder (15).

Petitions and Developments in the DU Copyright Controversy

Finally, it was Amlan?s turn to highlight the latest developments in the contentious copyright battle between Delhi University and a group of publishers. Unfortunately, as time is passing, the university may be showing signs of distancing itself from the photocopier and may not be resisting the suit with all diligence. Amlan has also referred to a petition available on Change.org that urges the publishers to drop the suit, which is gaining momentum rapidly.?

International Front

Apple loses UK Battle against Samsung

One of the biggest news of the week is definitely Apple?s loss in the UK lawsuit, where a three-judge panel in London upheld an earlier decision by a U.K. court that said several of Samsung?s Galaxy tablets weren?t ?cool? enough to be confused with the iPad and hence cannot be held to cause infringement of the latter?s designs. This is the latest in a series of rulings all across the world that have puzzled IP enthusiasts owing to their inconsistencies, with US deciding in favor of Apple and Tokyo, Australia and Netherlands favoring Samsung?s arguments.

DIGITALEUROPE accused of hijacking Mediation Process for having advocated Reforms

On another front, copyright collective management and creators? organizations have recently accused the digital technology industry group DIGITALEUROPE of trying to hijack a mediation process aimed at straightening out the EU?s messy system of private copying and reprographic levies. DIGITALEUROPE, in a recent paper setting out alternatives to device-based copyright levies, had urged the European Commission to initiate comprehensive reforms that include replacing levies with some other forms of compensation to rights holders.

USPTO set to update Code to conform with ABA Norms

In a much-awaited move, the USPTO has finally announced its proposal to update its Code of Professional Responsibility to conform to the Model Rules of Professional Conduct of the American Bar Association. The proposed package imbibes most ABA provisions with minor or no revision and codifies professional obligations already applicable to legal practice. The rules also propose to do away with the annual practitioner maintenance fee, which would no doubt be a popular move.

Pirate Bay reaches for the Clouds

WIPO moves closer to the Treaty for the Visually Impaired

On a bit of welcoming note, WIPO members have, over this week, inched a little bit closer to the much-awaited Treaty for the Visually Impaired, an international instrument facilitating access to copyrighted reading and educational material in special formats for visually impaired persons, through a set of exceptions and limitations to copyright. After three days of mostly informal discussions and a set of succeeding draft texts, the WIPO members finished on October 19 with a more agreeable draft, while identifying a few more areas where more work needs to be done.

US Universities? Digitization move gets supported by Court

On a similar line of development, the US District Court of New York took the side of the universities running the cutting-edge HathiTrust project to establish a repository to archive and share the digitized collections of partner institutions, particularly for purposes of full-text searches, preservation and access for people with print disabilities. The universities won the copyright infringement suit brought against them, as the court permitted their actions under the fair use doctrine as per Section 107 of the US Copyright Act.

In IP we trust: Church approves of IP Rights

Yet another fascinating event is the recognition of IP rights by none other than the Archbishop Silvano M. Tomasi, who at the recent General Assemblies of the World Intellectual Property Organization in Geneva, opined in an interview that the church finds ?human value? in IP and, as the latter protects and promotes innovation and creativity, it is good for humanity.?

Philippines not happy with US Special 301 Report

The Special 301 Report (identifying countries that deny adequate and effective protection of IP rights) published by the US Trade Representative was once again criticized, this time by the IP authorities in Philippines, who alleged that the retention of the country in that report despite significant progress having been made in curbing piracy and protecting IP rights has resulted in low morale amongst the enforcers. This in turn has caused the total worth of seized counterfeit products by government anti-piracy agencies for the first nine months of the year to fall 18% to P 4.12 billion from P 5 billion a year ago.?

UN: Southern Africa food shortages worsen

HARARE, Zimbabwe (AP) ? The United Nations deputy humanitarian chief says food shortages are "a chronic problem" in southern Africa and more than 5.5 million people in eight countries need aid this year, a 40 percent increase compared to 2011.

Catherine Bragg, winding up a five-day southern Africa trip Saturday, said worsening food shortages are the result of drought or floods and rising world food prices.

In Zimbabwe, 1.6 million people are affected by food shortages and many rural families have begun selling village livestock, often kept as a symbol of status and wellbeing, to cope with the "dire situation," Bragg said.

A decade of seizures of commercial farms has disrupted food production in Zimbabwe, a former regional breadbasket.

Food shortages are also particularly acute in Lesotho, Malawi and Swaziland, Bragg said.

Sony to cut HQ staff by a fifth, shutter Japan plant

TOKYO (Reuters) - Sony Corp said it will cut staff in its headquarters by a fifth and shutter a factory making camera lenses and mobile phones in Japan, providing new details of a previously announced plan to trim its global headcount by 10,000 by end-March.

In addition to 1,800 at a chemical business it sold to a state-run bank in Japan, Sony will let go roughly another 2,000 people from its head office and plant in Gifu, central Japan, Sony said in a statement on Friday.

Around another 2,000 workers will be trimmed in Europe, half at a joint mobile phone venture with Ericsson it recently ended. The remaining job losses will be at other factories around the world, the company said.

The maker of PlayStation and Bravia TVs expects the job cuts to save about 30 billion yen ($378.6 million) a year, funds the company needs as it struggles to stem losses in televisions and other consumer electronics operations.

Sony CEO Kazuo Hirai, who took the helm in April, has pledged to revive the once-stellar brand by bolstering gaming, digital imaging and mobile devices as well as by nurturing new business such as medical devices.

Sony's stock ended trading Friday at 983 yen, unchanged from the previous closing price. The company's share price has fallen 42 percent since Hirai took over six months ago.

Asia stocks mixed after US earnings disappoint

(AP) ? Asian stock markets were mixed Friday as disappointing U.S. corporate earnings hurt sentiment and provided a reason to book profits on recent gains.

Japan's Nikkei 225 index rose 0.1 percent to 8,994.63. South Korea's Kospi lost 0.9 percent to 1,941.89. Australia's S&P/ASX 200 rose 0.2 percent to 4,568.90. Hong Kong's Hang Seng added 0.2 percent to 21,556.39. Markets in mainland China, Singapore, Thailand, Indonesia and India were down.

"It is one of those situations where we've had such a big run this week, we are at a stage where investors would be nervous to add onto positions or get fresh entries," said Stan Shamu, market strategist at IG Markets in Melbourne, Australia.

Worse-than-expected U.S. earnings were a negative for Asian markets. Microsoft said net income fell a worse-than-expected 22 percent to $4.47 billion in the fiscal first quarter, which ended Sept. 30. Microsoft shares fell in after-hours trading.

Shares of Internet search trailblazer Google were pummeled after third quarter earnings were released three hours too early by mistake. The results alarmed investors because the company's earnings and revenue fell well below analyst projections. Google's stock price dropped 8 percent, causing $20 billion in shareholder wealth to evaporate.

BB&T bank, Philip Morris International and Boston Scientific also reported results that fell short of forecasts.

An unexpected jump in weekly U.S. jobless claims also hurt sentiment. The U.S. Labor Department reported Thursday that weekly applications for U.S. unemployment benefits jumped 46,000 last week to a seasonally adjusted 388,000, the highest in four months after falling sharply the previous week.

Investors are also looking for more progress from a European summit convened to hash out solutions to the region's debt crisis.

European Union leaders took a crucial step on the opening day of a meeting in Brussels on Thursday by agreeing to create a banking supervisor to oversee institutions in the 17 countries using the euro.

Among individual stocks, electronics maker NEC surged 8.9 percent in Tokyo after the Nikkei business daily reported that the company will likely report a sixfold increase in operating profit for the April-September period, beating forecasts.

The Dow Jones industrial average fell less than 0.1 percent to 13,548.94. The Standard & Poor's 500 index fell 0.2 percent to 1,457.34. The Nasdaq composite index slid 1 percent to 3,072.87.

Benchmark oil for November delivery was up 2 cents to $92.12 per barrel in electronic trading on the New York Mercantile Exchange. The contract fell 2 cents to finish at $92.10 a barrel on Thursday.

In currencies, the euro rose to $1.3070 from $1.3061 late Thursday in New York. The dollar rose to 79.29 yen from 79.23 yen.
