Rapid, point-of-care tests for syphilis: The future of diagnosis

Feb. 27, 2013 ? Syphilis is on the rise worldwide and there is an urgent need for reliable and rapid screening, particularly for people who live in areas where access to healthcare is limited. An international research team, led by scientists at the Research Institute of the McGill University Health Centre (RI-MUHC) in Montreal, has demonstrated that rapid and point-of-care tests (POC) for syphilis are as accurate as conventional laboratory tests. The findings, which were published in PLoS ONE, call for a major change in approach to syphilis testing and recommend replacing first line laboratory tests with POC tests globally, especially in resource-limited settings.

"There is a need to embrace rapid and POC tests for syphilis in global settings," argues Dr. Nitika Pant Pai, the study's senior and corresponding author, clinical researcher at the RI-MUHC and assistant professor in the Department of Medicine at McGill University. "This meta-analysis generates global evidence across all populations for POC tests for syphilis and is the first to use sophisticated analyses to explore the accuracy of POC tests compared to the best reference standards."

Currently, syphilis is screened using conventional laboratory-based tests that can take up to three weeks to deliver results. These tests require chemical agents, trained staff and a continuous supply of electricity, which are not readily available in some parts of the world. Rapid and POC tests can be performed on a simple finger stick sample one patient at a time, and the results communicated to the patient within 20 minutes, saving time and helping doctors order confirmatory tests and rapidly flagging patients who need treatment.

Syphilis is a sexually transmitted disease caused by the rod-like bacterium Treponema pallidum. It is transmitted between sexual partners through direct contact with a Syphilis sore. It may also be transmitted from mother to fetus during pregnancy or at birth, resulting in congenital syphilis. "As well timely screening and treatment in first trimester is extremely important for pregnant women to prevent still births, pre-term births and mother-to-child transmission of syphilis," adds Yalda Jafari, the study's first author and a former master's student of Dr. Pant Pai.

As many as 50 million people worldwide are being treated for syphilis and about 12 million new cases are diagnosed every year. However, approximately 90% of those infected do not know it, and this is the driving force behind the worldwide epidemic. The U.S. Centers for Disease Control (CDC) often refers to syphilis as the "great imitator," because many of its symptoms are similar to other diseases.

"Our study has major worldwide implications for populations living in rural areas with limited access to healthcare," says Dr. Pant Pai. "These tests offer the potential to expedite first line screening in settings where people have no access to a primary care physician or where laboratories take more than a week to deliver results."

Scientists' findings disclose a new and much needed test for river blindness infection

Scientists at The Scripps Research Institute (TSRI) have found a telltale molecular marker for Onchocerciasis or "river blindness," a parasitic infection that affects tens of millions of people in Africa, Latin America and other tropical regions. The newly discovered biomarker, detectable in patients' urine, is secreted by Onchocerca volvulus worms during an active infection. The biomarker could form the basis of a portable, field-ready test with significant advantages over current diagnostic methods.

"There has been a need for an inexpensive, non-invasive test that can discriminate between active and non-active river blindness infections during treatment campaigns," said Kim D. Janda, who is Professor and Ely R. Callaway, Jr. Chair in Chemistry, member of the Skaggs Institute for Chemical Biology, and director of the Worm Institute of Research and Medicine at TSRI. "We think that this new biomarker can be the basis for such a test."

The work is described in an online Early Edition of the Proceedings of the National Academy of Sciences during the week of February 25, 2013.

Leading Cause of Vision Loss

A leading cause of vision loss, Onchocerciasis infections are transmitted among humans by river-dwelling blackflies in tropical regions. The vast majority of cases occur in sub-Saharan Africa, although pockets of endemic infection exist in Yemen and in Central and South America. The major symptoms of the disease, including blindness, result from the spread of O. volvulus "microfilariae"?early-stage larval worms?to the eyes and other tissues, where they trigger damaging inflammatory reactions.

Mass treatment campaigns, begun in the 1990s, have used the anti-worm drug ivermectin, as well as the antibiotic doxycycline, which kills a symbiotic bacterium within the worms. The World Health Organization's African Programme for Onchocerciasis Control has set a target date of 2025 for the eradication of the disease in that region. But Onchocerciasis treatment is seldom effective immediately and often spares adult worms. The latter can remain in protected nodules under the skin of a patient and secrete microfilaria for a decade or more. Health agencies need better diagnostic methods not only to monitor the progress of Onchocerciasis treatment campaigns, but also to limit the use of ivermectin and doxycycline to reduce the risk of resistance.

Current diagnostic methods include the painful cutting of "skin snips" from patients for microscopic analysis and an ELISA antibody test for microfilariae, which may yield positive results even for non-active infections. "You can still have circulating antibodies to a nemotode antigen in your blood for a long time after the infection is gone," said Janda.

Looking for a Better Way

A better diagnostic marker would be a metabolite of O. volvulus that appears only during an active, microfilariae-producing infection and that could determine both the presence and the severity of disease. In 2010, Janda's laboratory demonstrated the feasibility of this approach by sifting through the small-molecule metabolites within blood samples from river blindness patients?a technique called "metabolome mining"?and finding a set linked to active onchocerciasis infection. For the new study, the team sought a simpler set of biomarkers?or better yet, a single unique biomarker in urine.

Daniel Globisch, a postdoctoral fellow in the Janda laboratory, started with samples of urine from onchocerciasis-infected and non-infected Africans. Using a powerful laboratory technique called liquid chromatography mass spectrometry, he measured the concentrations of hundreds of small-molecule metabolites in the samples. Excitingly, between the infected and non-infected urine samples, one difference stood out clearly: "An unknown small molecule was highly elevated in the samples from infected individuals," said Globisch.

In a process akin to looking for the proverbial needle in the haystack, Globisch was able to purify the mysterious metabolite, and, using mass spectrometry, determine the chemical identities of its individual pieces. "The metabolite itself wasn't present in the databases, so I searched the literature for what is known about the biosynthesis and metabolic pathways in these nematodes," Globisch said. Ultimately, he was able to identify the metabolite as N-acetyltyramine-O,?-glucuronide. Remarkably, this molecule's inception can be traced to O. volvulus as a neurotransmitter molecule that is secreted by young, reproducing worms and then modified by the human body on its way to being excreted in urine.

"It's a spectacular find in terms of biomarkers as it does not occur naturally in humans," Globisch said. Levels of the metabolite in a non-infected North American control sample were near zero.

Toward a Field Test

In urine samples from Africans with active onchocerciasis infections, Globisch found that levels of the biomarker were on average four to six times higher than in samples from Africans with non-active infections. In a separate test, the team determined that a full course of doxycycline treatment, which sterilizes or kills infecting worms by destroying their symbiotic bacteria, also reduced levels of the biomarker to near-normal. "This biomarker appears to be specific for an active infection," Globisch said. The wide gap between biomarker levels in active and non-active infections suggests that a field test based on the biomarker would be robustly useful.

Such a diagnostic, said Janda, might ultimately be a simple urine dipstick test, much like a home pregnancy test, which would indicate the amount of the O. volvulus biomarker present in the sample. "Ultimately for this to be of value in Third World countries we will need to morph this biomarker into something that's inexpensive, simple to use, tolerant of extreme temperatures and portable?basically distilling our finding to a test that can be carted around in a backpack," Janda said.

Importantly, he adds that Globisch's metabolome-mining approach in theory should be applicable to the development of diagnostic tests for other worm diseases.

Fujitsu Arrows V F-04E hands-on

Fujitsu had a third set on hand at its booth on opening day here at MWC 2013: the Arrows V F-04E. Launched as part of the NTT DoCoMo's winter lineup, this is the first opportunity we've had to get a hands-on as of course this set will never end up anywhere near our shores. The F-04E is loaded with everything one could expect in a high-end set like a 4.7-inch 720p display -- and it is wondrous to behold -- a 13.1-megapixel camera, 1.5GHz quad-core CPU, integrated 1seg TV antenna and a whopping 64GB of storage.

The Arrows V, aside from the odd obsession Fujitsu seems to have on insisting to hide all its USB ports under tough to open flip up open doors, is a very slick handset. The lines are clean, the display -- did we mention it is lovely? -- clear and easy read from every angle. Sadly for us the booth's requisite bowl of water or fountain was missing in action so we couldn't do a dunk test but we did manage to capture a bit of video and a gallery for you to enjoy.

Bridal registries might be efficient sparing the gift-giver from hours of shopping and the recipient from having to return unwanted items. But that convenience may come at a cost: Where once the mom held great sway over selecting the intimate items that shaped the new household, now Target, Macy's and other retailers have taken over that role.

"Decades ago, the main role of the mother of the bride was creating the new home for the union of two families," says Tonya Williams Bradford, assistant professor of marketing at the University of Notre Dame. "By turning to bridal registries, we've outsourced to the marketplace the sacred traditions of planning and outfitting a new family space."

"For the retailer, it certainly has increased the revenue," Bradford says. "And for the bride and groom, there is a broader net for who can participate, because all that is necessary is to communicate the registry website to potential gift-givers."

In her ethnographic study "Orchestrating Rituals through Retailers: An Examination of Gift Registry" (with Notre Dame Marketing Chair John Sherry) recently published in the Journal of Retailing, Bradford examines gift registries as part of a larger set of wedding rituals, and the implications of retailers playing a central role.

Weddings are not only the union of brides and grooms in matrimony and the creation of new family units, but also a lucrative industry. The research shows that in 2010 an estimated $19 billion in gifts were purchased from registries by invited guests, making wedding industry revenues second only to those of Christmas.

And the cost lies in more than the price tag.

"Roles formerly held by parents and grandparents, we as consumers now outsource," Bradford says, "And we're happy to do it."

The study reveals a number of findings about shifting the once very personal ritual of gift-giving to existing squarely within the marketplace.

"There is stiff competition among retailers to be the gift registry destination," Bradford says, "but registries also have changed our social fabric. The notion of gift-giving used to hold much more sentimental value. Now, everything is pretty much purchased, and, sadly, many people don't put a lot of thought into customizing those purchases."

The study considers how gift registries in general have changed the act of gift giving, as well as family traditions associated with various occasions, from welcoming a new baby to sending a teen to college.

"We used to make beautiful gifts to celebrate the birth of a new baby," Bradford says, "Friends and family would crochet blankets and knit hats and booties. Now we simply shop a registry at Babies R Us."

There are ways to preserve a slice of lost traditions, Bradford says.

"For gift-givers, find ways to customize the gift you select from the registrymake it personal," she says. "For gift recipients, make receipt of the gift a ceremonious occasion. Don't just pick up the package from the porch. Be prompt and personalize your expression of gratitude, ideally on personalized stationary. Describe for the gift giver in detail how you intend to use the gift."

The "Family Guy" creator was asked on his Twitter account whether he'd consider hosting the Academy Awards again and he replied: "No way. Lotta fun to have done it, though."

MacFarlane's edgy comedy proved a polarizing force on Sunday's Academy Awards, with jokes about domestic violence, women's bodies and Jews in Hollywood that offended some viewers. The Oscars did get their biggest audience in three years, however, with particular growth among young viewers.

MacFarlane's spokeswoman said Tuesday she had nothing to add to the tweet.

Reuters reports that India has gone on high alert after the explosions, which local television stations report may have killed up to 15 people and wounded at least 50.?The last major bomb attack in India was a blast in September of 2011 outside the high court in New Delhi that killed 13 people.

"Both blasts took place within a radius of 150 meters," federal Home (Interior) Minister Sushil Shinde told reporters, adding the explosives were placed on bicycles parked in the crowded marketplace. "Eight people died at one place, three at the other."

The explosions come less than two weeks after India hanged a Kashmiri man for a militant attack on the country's parliament in 2001 that had sparked violent clashes.

Witnesses told Reuters they heard at least two explosions in the Dilsukh Nagar area of Hyderabad just after dusk but there could have been more.

The Hindustan Times reports that Home Minister Sushilkumar Shinde told reporters that "it was too early to say anything" about whether it was a terrorist attack, but that the government was investigating. But the Times notes that the country had already been on alert for attacks due to the recent execution of Mohammad Afzal Guru, a convict in the 2001 terrorist attack on the Indian Parliament.

The Monitor reported earlier this month that Mr. Afzal Guru's death sentence, though handed down in 2002, was carried out on Feb. 9 without advance warning, and appears to involve a significant political impetus.

The execution is being seen by analysts as the ruling Congress party?s way of regaining public confidence in the wake of several corruption scandals and protests over the recent Delhi gang-rape. Political commentator Seema Mustafa says the sudden decision to execute Afzal Guru, after years of dilly-dallying, is part of a Congress party effort?to improve its position for the 2014 general elections. ?The Congress in its usual cynical manipulation of the votes is trying to eat into the majority constituency with this action,? she says.

Executions had become more rare up until [that of Ajmal Kasab, the lone surviving terrorist in the 2008 Mumbai attacks] ? the first in India in eight years. Like Kasab's hanging in November, Azfal Guru's?came just ahead of a parliament session. ?I would just say it's extremely tragic if Indian democracy is going to survive on executing someone or the other before every Parliament session,? says lawyer Vrinda Grover. Congress party spokesman?Abhishek Manu Singhvi called such suggestions about the timing "irresponsible and childish."

The execution led to days of protest in Kashmir, where Afzal Guru was from.

HAVANA ? Retired Cuban leader Fidel Castro made a rare public appearance Sunday by joining the opening session of the National Assembly, state media reported amid speculation the gathering could give clues on planning for a future leadership succession.

Since falling ill in 2006 and ceding the presidency to his brother, Fidel Castro has given up all official positions except as a deputy in the National Assembly. At Sunday's session, he took his seat beside brother President Raul Castro, only the second time he has graced the assembly chambers since his illness and the first since 2010.

Fidel Castro's surprise appearance added to expectations, fueled by his brother, that the usually routine session might shed light on future leadership of the communist-run nation.

In a back and forth with reporters on Friday, Raul Castro joked about his eventual retirement and urged them to pay attention to Sunday's conclave, which is closed to foreign journalists.

"I'm going to turn 82; I have a right to retire already," he said. "You don't believe me? Why are you so incredulous?" he said.

The 612 deputies, who were elected in an uncontested vote February 3, named a new 31-member Council of State with Raul Castro as president, despite his quip.

The National Assembly meets for just a few weeks each year and delegates its legislative powers between sessions to the Council of State, which also functions as the nation's executive through the Council of Ministers it appoints.

Governments, Cuba watchers and Cubans were watching to see if any new, and younger, faces among the Council of State members, in particular its first vice president and five vice presidents, with an average age over 70.

Miguel Diaz-Canel, a 52-years old electrical engineer and university professor who is a rising star on Cuba's political scene, was named first vice president of Cuban Council of State and first vice president of Cuban Council of Ministers, hinting at some, relatively young, new blood for the future.

Esteban Lazo, member of the political bureau of the Community Party and vice president of the Council of State, 68, was named parliament president Sunday to replace a retiring Ricardo Alarcon, who served for 20 years.

The new government is almost certain to be the last headed up by the Castro brothers and the generation that has ruled Cuba since they swept down from the mountains in the 1959 revolution that led to a long-running feud with Washington.

Raul Castro, 81, would begin his second term on Sunday, theoretically leaving him free to retire in 2018, aged 86.

Eighty percent of the parliament's 612 members, with an average age under 50, were born after the Revolution.

Raul Castro, who officially replaced his ailing brother as president in 2008, has repeatedly called for senior leaders to hold office for no more than two, five-year terms.

"Although we kept on trying to promote young people to senior positions, life proved that we did not always make the best choice," Castro said at a Party Congress in 2011.

"Today, we are faced with the consequences of not having a reserve of well-trained replacements....It's really embarrassing that we have not solved this problem in more than half a century," he said.

The 2011 party summit adopted a more than 300-point plan to "update" Cuba's Soviet-style economic system, designed to transform it from one based on collective production and consumption to one where individual effort and reward play a far more important role.

Across-the-board subsidies are being replaced by the country's first comprehensive tax code and targeted welfare.

Fidel Castro, these days referred to as the "historic leader of the revolution," is no longer seen as wielding real power, but he has maintained a public presence through his writings, meetings with important visitors and rare appearances.

Samsung Announces Galaxy Note 8, Aiming To Dethrone The iPad Mini

BARCELONA, Spain (AP) ? Samsung Electronics is beefing up its tablet range with a competitor to Apple's iPad Mini that sports a pen for writing on the screen.

The Korean company announced on Sunday in Barcelona that the Galaxy Note 8.0 will have an 8-inch screen, putting it very close in size to the Apple's tablet, which launched in November with a 7.9-inch screen. It's not the first time Samsung has made a tablet that's in the Mini's size range: it's very first iPad competitor had a 7-inch screen, and it still makes a tablet of that size, but without a pen.

Samsung will start selling the new tablet in the April to June period, at an as yet undetermined price. It made the announcement ahead of Mobile World Congress, the wireless industry's annual trade show, which starts Monday in Barcelona, Spain.

The Note 8.0 fills a gap in Samsung's line-up of pen-equipped devices between the Galaxy Note II smartphone, with its 5.5-inch screen, and the Galaxy Note 10.1, a full-size tablet. Samsung has made the pen, or more properly the stylus, one of the tools it uses to chip away at Apple's dominance in both tablets and high-end smartphones. Apple doesn't make any devices that work with styluses, preferring to optimize its interfaces for fingers, mice and touchpads.

On Samsung's Note line, the pens can be used to write, highlight and draw. The screens also sense when the mouse hovers over the screen, providing an equivalent to the hovering mouse cursor on the PC. However, few third-party applications have been modified to take full advantage of the pens.

Governors seek flexibility in sequestration

(Chip Somodevilla/Getty Images)WASHINGTON --?Governors frustrated by the prospect of $85 billion in across-the-board federal spending cuts set to kick in next week have made the "F-word" their term of choice at the annual winter meeting of the National Governors Association.

That word, of course, is "Flexibility."

"We believe in what we call flexible federalism," said Delaware Gov. Jack Markell, a Democrat who chairs the NGA. "That's a strong cooperative relationship between the states and the federal government that solves problems at all levels."

He added, "We know that cuts are coming, but we also don't want to suffer disproportionally. We want to have some input on what that looks like."

Barring an agreement between Congress and the White House before March 1, the federal government will begin a process known as the "sequester," shaving about $1.2 billion, or 2.5 percent, off the budget over the next decade.

Governors say they accept that they will receive fewer resources from the feds as a result, but they want to soften the blow by having more freedom in choosing how to use the more limited federal dollars. The scope of the struggle for power between the national government and the states is wide, ranging from whether states should be able to use federal transportation dollars on bike paths to how they should implement provisions of ?the Affordable Care Act, better known as Obamacare.

The desire for flexibility is shared among the governors across both party and ideological lines. As a group, they argue that if the federal government were to loosen the mandates and rules controlling federal grants and cooperative programs, events like the sequester wouldn't have nearly as much of a bite.

"It's wreaking havoc upon the states and our state budgets," said Oklahoma Gov. Mary Fallin, a Republican."Give us some leeway."

The call for breathing room, however, appears to be falling on deaf ears in Washington. Fallin took her concerns directly to the White House during a meeting with President Barack Obama Saturday, she said, but Obama did not express openness to proposals.

"He said that was an area where he was less inclined to work with the governors," Fallin said.

Many state lawmakers are still shaping their budgets for the next year, a complicated process made more difficult by the fiscal uncertainty. Between the "fiscal cliff," the "sequester" and other you-can't-make-this-stuff-up crises coming from the nation's capital, the states are left merely guessing how much they can depend on the government for support.

It also doesn't help that federal government has been running without a traditional budget since the first year of the Obama presidency.

The cycle of governing through last-minute deals has left even staunch supporters of the president frustrated.

"It is literally impossible for us to meet our necessary requirements of balancing our budgets and putting our programs and projects together if we are living under an uncertainty with respect to whether or not our federal dollars are going to be there," said Hawaii Gov. Neil Abercrombie, a Democrat. "We don't have a budget from the United Sates of America!"

It's almost as if they really just want to use the other F-word.

MCC roadThe Japanese government is to fund two major projects under the Eastern Corridor Development Project being undertaken by the Ministry of Roads and Highways.

The projects are the construction of the road network from the Asutuare Junction through Volivo to the Asikuma Junction and a new bridge over the River Volta.

The bridge is estimated to cost $99.4 million, while the stretch from the Asutuare Junction to Volivo and the road between Dufor Adidome and the Asikuma Junction are estimated to cost $66.5 million and $94.9 million, respectively.

The projects will be financed under the Japan International Cooperation Agency (JICA), which is part of Japan?s official development assistance programme.

When completed, the new bridge will reduce the stress on the Adomi Bridge, which provides a critical connection from the Eastern and Greater Accra regions to the Volta Region.

The Japanese Ambassador to Ghana, Mr Naoto Nikai, expressed Japan?s commitment to finance the projects when he interacted with the Minister of Roads and Highways, Alhaji Amin Sulemani.

Mr Naoto had paid a courtesy call on Alhaji Sulemani to congratulate him on his appointment and also discuss issues of mutual interest to the two nations.

Ghana?s relationship with Japan dates back to 1927 when Dr Hideyo Noguchi visited Ghana (then the Gold Coast) for research on yellow fever. The two countries have since maintained a good relationship, which has resulted in the Far East country supporting Ghana in some of its developmental projects.

The government of Japan regards Ghana as one of the most important countries in terms of Japan?s aid policy toward Africa.

Ghana has been the biggest recipient country in sub-Saharan Africa with regard to economic cooperation from Japan since 1997 and Japan has been the leading donor country for Ghana since 1988.

Already, Japan is funding the reconstruction of the Yamoransa Junction-Bekwai road and also building a bridge to connect Assin Praso to Assin Adanse in the Central Region.

Japan suspended its loan facilities to Ghana when the country opted for the Heavily Indebted Poor Countries (HIPC) initiative. Subsequently, Japan cancelled Ghana?s debt of $1 billion owed it in 2004.

Mr Nikai explained that the Japanese government had decided to support Ghana with what it called Yen loans to assist in Ghana?s development strides.

Alhaji Sulemani expressed the readiness of his ministry to partner the Japanese government to develop Ghana?s road infrastructure.

Silver Linings Playbook is defined by the positive decisions that are made in the face of imperfection, desperation, and the desolate wasteland of your world in pieces.

Director David O. Russell forms a unique and incredible romance dramedy...

There is some charm to the story, but the final act is very neat, predictable, contrived, and not up to originality of the first two.

Director David O. Russell is a little too chipper at times - breaking a restraining order is really no joke - but he brings a breeziness to this likeable tale of two misfits trying to make it work.

It may be a Hollywood comedy, but it's one that feels beautifully alive.

On the surface Silver Linings Playbook is a raucous romantic comedy, but its real interests are superstition and delusion.

A volatile mix of familial drama and madcap comedy, infectious optimism and razor-wire wit, it's one of the most purely enjoyable films released in the past twelve months.

It starts to fray about halfway through as it shifts into a more conventional mode, taking on the usual trappings of the genre and making its way to a predictable resolution

Both charming and gritty... Cooper is edgy, while Lawrence is dynamite

If there's one reason why you should see this film, it's to admire the wonderful performances from Bradley Cooper and Jennifer Lawrence.

Property mogul and reality TV star Donald Trump is on the hunt for cyber criminals who hacked into his Twitter.com account and posted raunchy lyrics to a song by Lil Wayne.
Fans of the Celebrity Apprentice boss were left puzzled on Thursday when the businessman appeared to quote rap track Scream & Shout.
A post on his social networking page read, ?These h**s think they classy, well that?s the class I?m skippin?, but the tweet was promptly deleted as soon as Trump spotted the mystery message.
He alerted his two million followers to the Twitter intrusion, writing, ?My Twitter has been seriously hacked ? and we are looking for the perpetrators.?
Trump then warned Twitter bosses they needed to step up their security software to prevent losing users, adding, ?Twitter will soon be irrelevant if lowlifes are so easily able to hack into accounts.?
However, the online attack didn?t stop the real estate tycoon from returning to the micro-blogging site ? he was back to tweeting on Friday.
Trump isn?t the only star to take action against online hackers ? Australian supermodel Miranda Kerr is also working with an Internet crime unit to track down the fraudster who recently logged into her Twitter page.

(AP) ? Las Vegas is combining its love of mega pop-stars and over-the-top theatrics for a new Michael Jackson Cirque du Soleil show opening this summer.

Cirque du Soleil CEO Daniel Lamarre announced Thursday that the company's newest show will be called "Michael Jackson ONE." The show at Mandalay Bay Resort and Casino on the Strip will start preview performances May 23. It will officially premiere June 29.

The show is the second collaboration between the acrobatic company and Jackson's estate. The first production was the traveling show, "Michael Jackson: Immortal World Tour."

The title is intended to evoke a central paradox of the king of pop's multifaceted persona and changing musical styles.

Upcoming Changes to Personal Injury Claims | Feb 21, 2013

Lancashire, England -- (SBWIRE) -- 02/21/2013 -- More than three years ago, Lord Justice Jackson was tasked with the job of undertaking an inquiry into personal injury claims and reforming the industry. The reform is due to go into effect from April 1 and major rule changes will come into effect under the new legislation. These changes could affect any businesses as well as individuals who are entitled to make claim, but the new laws are not widely known. Here is a look into what the new legislation entails and involves.

Lord Justice Jackson has endeavored to make the rule changes more cost-effective than previous incarnations. He is proposing a system wherein cost shifting will generally reduce costs. In his revised rulings, the claimant would not be required to pay the defendant?s legal costs upon losing. Although the defendant would still be required to pay the claimants legal costs is the claim is successful. This removes the risk previously attached to making an accident injury claim. Under current rulings the claimant is forced to pay the defendant?s legal costs when making an unsuccessful claim. Currently this cost is subsidised by the claimant taking out an insurance policy. This insurance is in itself an additional cost that the new proposal hopes to abolish.

Furthermore, Lord Justice Jackson has made significant changes to industrial disease and medical negligence claims. Many people have criticised the current industrial disease claim model due the protracted length that the process takes. Medical proof from experts is needed at almost every step of the process and can prolong the claim. Jackson has attempted to diminish this prolonged waiting time by imposing time limits.

The medical body would be liable for a fine if they have not produced the necessary records within 60 days. Additionally any medical records that are not produced within 40 days, will not incur a fee payable. It is hope that these financial incentives will encourage medical bodies to improve their efficiency and speed when producing important records and results for medial claim cases. This will also help reduce additional costs in some cases.

All of these changes that Lord Justice Jackson is imposing are designed to help bring justice to those who deserve it. The changes are an attempt to make the legal system fairer so anybody who is entitled to compensation has a fair chance to claim it.
